A man is suing Red Lobster restaurant for $1 million following a waitress deciding to post a very racist receipt online, prompting a national controversy and viral investigation into the matter. The testy incident recently occurred in Franklin, Tennessee, after the man opted to sue the waitress and the restaurant after the young woman shared his signed guest check on the Web, complete with the offensive comment — the N-word — cited on it. However, Investor Place News offers an updated twist to the story this Friday, May 30, noting that the waitress has been allowed to return to work after being suspended, and a writing expert confirming that the accused man did not, in fact, write the wrongful word.
When a man sues Red Lobster, you know there’s likely a significant reason behind it — and it probably has nothing to do with a dislike of seafood. In this case, a Tennessee man accused the popular restaurant and a waitress of defaming him by posting a private receipt on the Internet. His lawsuit asked for $1 million once he started getting hate emails and negative press, as the guest check had the N-word written directly next to the signature.
The man in question is Devin Barnes; in the midst of the racist receipt going viral online, he hired an attorney to file an official complaint, saying that a “malicious and willful act” had occurred, complete with “slander and the unlawful public release of Devin Barnes’ personal information on the Internet without his permission.”
It was Counton 2 News that shared earlier this month that Barnes’ mother has also stepped into the legal fray, saying that she believes her son is right to sue for the $1 million because his reputation has become so damaged over this affair.
“It’s still all over the Internet. It is still affecting his life and all of our lives.”
The controversy that led to the man suing Red Lobster for all that money actually took place back in late 2013, when waitress Toni Christina Jenkins waited on Barnes to jot down a to-go order for him at a Red Lobster in Franklin. Barnes paid with a credit card, paying the $44, but did not offer a tip, simply writing “none” where the possible tip should go. However, around that time, a racist message, the N-word, was allegedly also written on the receipt.
Jenkins soon took to Facebook to vent her frustration and hurt, posting the receipt and Barnes’ personal information on the guest check. The accused man said he began to receive threats after the post soon became viral. While Barnes acknowledged he may have been cheap in not leaving a tip, he never wrote the derogatory word.
An expert was eventually hired, and it was determined that the handwriting did not match with that of the racist receipt, meaning that Barnes conclusively did not write any N-word on the check. Jenkins is now saying she didn’t write the N-word either, but she doesn’t know who might have done so in the interim.
“I know I didn’t write it. If he says he didn’t write it, I believe him wholeheartedly. I’m that kind of person, I have nothing against him or his family,” she said in a statement.
Red Lobster has since rehired Jenkins after suspending her for posting information on the Internet and hearing of the man sues Red Lobster lawsuit:
“As we shared before, it is against our policy to post guest information online. Our standard procedure is to suspend the employee involved with pay while we determine what happened. After the completion of a full investigation into this matter, Miss Jenkins returned to work. As we also shared, we were disgusted by the language used on this guest check as it has no place in our restaurant or anywhere else.”
Since then, Jenkins has gotten well over $10,000 in donations once the story went viral on the Internet. The grateful waitress says she will save it for college.
